1. Controller
The controller responsible for processing personal data in connection with KidzArte is:
KidzArte Mr Rainer Schoch Talacker 9 8259 Kaltenbach Switzerland Email: info@kidzarte.ch
Technical development and support: WEBDUO GmbH, Wendelstrasse 4, 8646 Wagen, Switzerland. WEBDUO GmbH provides technical development and support for the KidzArte platform on behalf of the controller.
2. Purposes of processing
KidzArte is an exhibition platform for children and young people. Personal data is processed in particular to receive and review applications, organise participants and exhibitions, document parental or guardian consent, present artworks and approved artist profiles, communicate with participants and guardians, publish news and retrospectives, present sponsors and partners, and operate the platform securely and reliably.
3. Data relating to children and young people
Depending on the use of the platform, data may include first and last name, date of birth or age, contact details, exhibition information, artwork details, artist profile, images of artworks and other voluntarily provided information. As KidzArte is aimed at minors, personal data is handled with particular care. Only information intended and approved for the exhibition is made public.
4. Consent of parents or legal guardians
Participation by minors requires the consent of a parent or legal guardian. KidzArte may provide a PDF consent form for this purpose. The signed document can be uploaded or submitted through another designated channel. Consent documents are stored securely and are not publicly accessible. Consent may be withdrawn for the future within the limits of applicable law.
5. Artworks and sale prices
Participants may present their artworks through KidzArte and, if desired, specify a sale price. Public information may include title, technique, dimensions, year of creation, image of the artwork, artist name and stated sale price. Participation in KidzArte is free of charge.
6. Photographs, retrospectives and publication
Photographs and other images may be created in connection with exhibitions. Images in which minors are identifiable are published only where the required approval or consent is available. KidzArte uses an internal approval process for this purpose. Internal storage does not automatically mean public publication.
7. User accounts and administration
User accounts may be created for certain functions. Name, email address, user role, login information and security-related log data may be processed. Passwords are not stored in plain text. Access to administrative functions is restricted according to roles and permissions.
8. Server, security and analytics data
When the website is accessed, technically necessary data such as IP address, date and time, pages accessed, browser information, status codes and error data may be processed. This supports secure operation, troubleshooting and abuse prevention. KidzArte may also use its own local visitor statistics. Statistical data can be deleted by authorised administrators.
9. Email communications
KidzArte may send emails relating to applications, consent, exhibitions and organisational processes. The necessary contact and content data is processed for this purpose.
10. AI-assisted translations / OpenAI API
For editorial content, particularly news, KidzArte may use the OpenAI API to translate German text into French, English and Italian. Only editorial content selected by an administrator for translation is transmitted. Consent documents, passwords and confidential participant or contact data are not intended for this function. According to the information published for the API, OpenAI does not use API inputs and outputs to train its models by default unless data sharing is explicitly enabled. Technically necessary logging and retention by the provider may nevertheless occur.
11. Hosting
The website is hosted by Hostpoint AG, Neue Jonastrasse 60, 8640 Rapperswil, Schweiz. Website files, databases, uploaded documents and images, backups, and technical server and log data may be processed as part of the hosting service. Hostpoint processes technical log data in operating its services and may act as a processor on behalf of the controller.
12. Backups and retention
Backups are created to ensure reliable operation. Personal data is retained only for as long as required for the relevant purpose, exhibition documentation, security or legal obligations. KidzArte provides functions for data management and anonymisation. Non-personal information about past exhibitions may remain in an archive.
13. Disclosure and international processing
Personal data is not sold. Data is disclosed only where required for operation, where consent exists, where there is a legal obligation, or where service providers are used. Where services may involve processing outside Switzerland, the safeguards required by applicable data protection law are taken into account.
14. Rights of data subjects
Data subjects or their legal representatives may, within the scope of applicable data protection law, request information about personal data processed and, depending on the circumstances, request correction, deletion, restriction or provision of data. Consent may be withdrawn for the future where permitted by law. Requests should be sent to info@kidzarte.ch.
15. Data security
KidzArte uses appropriate technical and organisational measures, including protected administration areas, roles and permissions, protected storage of consent documents, upload checks, logging of security-relevant activities and regular backups.
16. Amendments
This Privacy Policy may be updated if functions, service providers or legal requirements change. The current version published on kidzarte.ch applies.
