Version: October 2026
1. Scope
These conditions apply to applications, participation and exhibitions organised through KidzArte. KidzArte is an exhibition platform for children and young people and is not a competition. There is no jury assessment and no entitlement to a prize.
2. Organiser
The organiser/operator is:
KidzArte Mr Rainer Schoch Talacker 9 8259 Kaltenbach Switzerland Email: info@kidzarte.ch
3. Participation and application
Participation in KidzArte is free of charge. Applications must contain the information and at least one artwork requested in the relevant exhibition call, unless otherwise stated. An application does not create an automatic right to participate. KidzArte reviews submissions and may approve or reject them. A maximum number of exhibited works may be set for each participant.
4. Minors and consent
For minors, consent from a parent or legal guardian is required. The KidzArte consent form must be completed truthfully and, where required, signed and submitted. Without the necessary consent, participation, publication or presentation may be restricted or refused.
5. Artwork requirements
Submitted works must generally have been created by the named young artist. Submissions must not infringe third-party rights, be unlawful or be clearly unsuitable for a children's and youth exhibition. KidzArte may reject or remove works for objective, organisational, legal or safety reasons.
6. Publication and rights of use
Copyright in the artwork remains with the artist. Within the scope of the consent granted, KidzArte receives a non-exclusive right to use approved images of works, names, profile information and approved photographs for the organisation and promotion of the relevant exhibition on the website, in exhibition materials, news, retrospectives and KidzArte communications. Any broader use requires the necessary permission.
7. Sale of artworks
Artworks may be displayed with a sale price. Unless expressly agreed otherwise, KidzArte is neither seller nor buyer and does not process payments. A purchase agreement is concluded directly between the interested buyer and the artist or, for minors, the responsible parent or legal guardian. Handling, payment, handover, shipping and any tax or legal obligations are the responsibility of the parties involved. KidzArte provides no warranty for such transactions.
8. Delivery, exhibition and collection
Dates and requirements for delivery, installation, exhibition and collection are communicated for each exhibition. Participants or guardians are responsible for complying with these requirements. Works not collected on time will be stored safely where reasonably possible; there is no right to indefinite storage.
9. Care and liability
KidzArte handles submitted works with reasonable care. To the extent permitted by law, liability is excluded for slight negligence, normal wear and tear, or damage outside KidzArte's sphere of influence. Statutory rules apply to intentional or grossly negligent damage and to liability that cannot legally be excluded. Participants should consider appropriate insurance for particularly valuable or sensitive works.
10. Changes and cancellation
KidzArte may change dates, programme, venue or procedures for organisational, safety-related or other important reasons. If an exhibition must be cancelled or postponed, affected participants will be informed where reasonably possible. As participation is free, there is generally no entitlement to reimbursement of participants' own expenses, to the extent permitted by law.
11. Conduct and protection of participants
Respectful and age-appropriate conduct is required. KidzArte may exclude persons or content where necessary to protect children and young people, ensure a safe event or protect legitimate interests of others.
12. Data protection
Personal data is processed in accordance with the current KidzArte Privacy Policy. Required consents are given particular consideration for minors.
13. Final provisions
If individual provisions are invalid, the remaining provisions remain unaffected. Swiss law applies. Mandatory statutory places of jurisdiction remain reserved. The current version of these conditions is published on kidzarte.ch.
